These Tournament Organiser Terms apply when you use the Clutch Tournament Organiser App. They add to our Terms of Service, Privacy Policy, and Grievance & Content-Takedown Policy, which also apply. Where these conflict with the Terms of Service on an organiser-specific matter, these govern. "You" or the "Organiser" means the person or entity organising tournaments through the app. By ticking "I agree" or using the app, you accept these Terms.

1. What you can do

You can create and list tournaments, take registrations through the Player App, schedule matches, assign referees, run a tournament to its result, and buy add-ons such as live streaming and premium features.

2. You run your own events; Clutch provides the technology

2.1 You are solely responsible for organising and conducting your tournaments — including the venue and any permits or permissions, the safety of participants, fair and accurate conduct, accurate listings and rules, scheduling, results, and resolving participant disputes.

2.2 Clutch provides the technology and facilitates registration and payment. Clutch is not the organiser of your event and is not responsible for it.

2.3 You are responsible for complying with all laws that apply to your event, including any laws on permits, prizes, competitions, or gaming.

3. Registrations, fees, and settlement

3.1 Players register and pay through the platform. Registration fees collected for your tournament belong to you and are settled to your account through our payment partner; Clutch does not take these amounts into its own account.

3.2 Clutch may charge a platform fee to players and/or, where notified to you, a commission to you. These are Clutch's revenue and are shown in the app.

3.3 We may deduct any tax required by law (such as tax collected or deducted at source) before settling amounts to you, and provide the related certificate. You are responsible for your own taxes, including any GST on your supplies, and for issuing any invoices to participants.

3.4 You bear the cost and risk of refunds and payment chargebacks relating to your tournament.

4. Cancellations and refunds

If you cancel, reschedule, or change a tournament, you are responsible for handling refunds and communications with registered players. Clutch's general no-refund policy applies to amounts Clutch charges; refunds of registration fees are your responsibility.

5. Referees

You assign referees to your matches and work with them to score. Referees are engaged by you, not by Clutch; Clutch provides only the technology. You are responsible for selecting, vetting, and supervising your referees, including their conduct towards players.

6. Registrant data

6.1 To run your event you receive personal data about registered players. For that data you act as an independent data controller and must comply with the Digital Personal Data Protection Act, 2023 and other applicable law — using it only to run the event, keeping it secure, honouring players' rights, and not selling it or using it for unrelated marketing without the consent the law requires.

6.2 You must promptly report any suspected data breach or misuse to Clutch.

7. Streaming and add-ons

Add-ons such as live streaming are paid features. You can stream on Clutch's channel (Clutch is the publisher) or connect your own account to stream on your channel (you are the publisher, are responsible for the stream, and are bound by the streaming platform's terms). You must have the right to stream your event and must respect the rights of those shown.

8. Your content

You are responsible for your tournament listings and other content; you confirm you have the rights to it and that it is lawful and accurate. You grant Clutch a licence to host and display it to provide the services. Scoring and overlay technology is provided by Clutch.

9. Your responsibility to us

You will indemnify Clutch against claims, losses, and costs arising from your event, from the conduct of you, your referees, or your participants, from your content, from your breach of these Terms, or from your violation of the law or another person's rights.

10. Conduct

Run your events fairly and honestly, provide accurate information, and respect players, referees, and venue staff. The Acceptable Use rules in the Terms of Service apply to everything you do in the app.

11. Suspension and termination

Clutch may suspend or remove your access for breach, security, or legal reasons. Your data-protection and confidentiality obligations, your indemnity, and any accrued payment obligations continue after your access ends.

12. Liability, changes, governing law, and grievances

Liability, disclaimers, changes, governing law, the preservation of your consumer rights, and the grievance process are as set out in the Terms of Service and the Grievance & Content-Takedown Policy. These Terms are published at the URL above and identified by version date; we will notify you in the app of any material change before it applies.
