Curved Consistency Technologies Private Limited ("Clutch," "we," "us") operates the Clutch app suite and the website at theclutchsports.com. This Privacy Policy explains what personal data we collect, why, how we use and share it, and the choices and rights you have. We are the Data Fiduciary for the personal data described here. By creating an account, using our apps, or using our website, you acknowledge this Policy; where the law requires your consent, we ask for it separately, and you can withdraw it at any time.

1. Who we are and how to reach us

2. Who this Policy covers

This Policy applies to all users of our apps — players, venue owners and their managers, tournament organisers, and referees — and to visitors to our website (theclutchsports.com), including its analytics, cookies, and any contact or newsletter forms. Note that venues and tournament organisers also decide how they use the data they receive through the platform; for those uses they act as independent data controllers and their own privacy practices apply alongside this Policy.

3. Eligibility — our apps are for adults (18+)

Our apps are only for individuals aged 18 or older. We collect your date of birth at sign-up and block access for anyone under 18. We do not knowingly create accounts for, or process the account data of, minors; if we learn that an account holder is under 18, we will block and delete that account.

Please note: recordings made at a venue may capture other individuals present on or around the court, who may include minors. Venues display notice that the area is recorded. We do not knowingly publish, live-stream publicly, or use for marketing the identifiable image of a minor unless the venue or organiser has obtained the consent of that minor's parent or guardian (see Section 8).

4. The personal data we collect

4.1 Information you give us: your name, date of birth, mobile number and email, password, the content you choose to put on your sporting profile, tournament registration details, your communications with us, and information needed to take payment (processed by our payment partner — see Section 9).

4.2 Information created when you use the apps: your game recordings and the footage from them (which contains images of you and of others present), your gameplay, performance, and analytics data, referee scoring data, your in-app activity, and the venue/location associated with a session. We also collect technical and device information — for example, device model, operating system, app version, unique device and advertising identifiers, IP address, and log and crash data.

4.3 Information from others: session recordings captured at venues; registration and participation data shared by tournament organisers; payment confirmations from our payment partner; and, if you connect a third-party account (see Section 11), limited information from that account.

5. Fitness and activity data (Clutch Coins)

5.1 If you join Clutch Coins, our rewards programme, we collect activity and fitness data — such as steps taken, calories spent, and distance covered while you play at listed venues — and use it to calculate the coins you earn. To provide this feature, the platform asks your permission to access your physical-activity and location data; you choose whether to grant it.

5.2 We collect only the activity data needed to run the programme, keep it secure, and use it only for Clutch Coins and the related rewards — not for advertising. We do not share your fitness data with third parties for their own purposes; any service provider that helps us store or process it acts only on our instructions under contract.

5.3 We treat your fitness data with extra care. You can leave Clutch Coins and stop this collection at any time in your settings.

6. How we use your data

6.1 We use personal data to:

  • (a) provide and operate the apps — recording and storing your games, generating highlights and analytics, hosting your profile, running tournament registration, scheduling and scoring, and live streaming;
  • (b) process payments and settle amounts to venues and organisers;
  • (c) improve our services and, internally, train and refine our analytics and related models using game footage and data;
  • (d) communicate with you about your account and the services;
  • (e) with your consent, promote Clutch and participating venues, including on social media;
  • (f) keep the platform safe and prevent fraud and misuse;
  • (g) comply with law and respond to lawful requests; and
  • (h) handle your queries and grievances.

6.2 We may create and use aggregated or anonymised data that cannot reasonably identify you — for analytics, research, safety, and improving the services — without restriction other than as the law requires.

7. Consent and your choices

7.1 We process the data needed to deliver a feature you ask for (for example, recording a game you start) on the basis of the consent you give when you use it, and other applicable lawful bases under the Digital Personal Data Protection Act, 2023.

7.2 Some uses are optional and are off unless you switch them on. These include: marketing communications; allowing Clutch and the venue to use your game footage and images for marketing and on social media; and making content public. Each is a separate, opt-in choice that you can turn on or off at any time in your settings.

7.3 You can withdraw any consent as easily as you gave it. Withdrawing consent will not affect processing already carried out, and may mean some features no longer work for you.

7.4 We do not sell or license your footage to third parties for their own independent commercial use.

7.5 If you opt out of marketing, we will still send you essential service and account messages — for example, security alerts, payment receipts, tournament confirmations, and important notices.

8. Recordings, footage, profiles, and live streaming

8.1 Games are recorded at venues using equipment connected to the venue's cameras. Venues display notice that the area is recorded and may be streamed.

8.2 Footage of a session may show you and other people present. You control whether you share your recordings, and with whom.

8.3 Your sporting profile is public by default, and you choose everything that appears on it; you can switch your profile to private at any time in settings. We make the default-public setting clear when you create your profile.

8.4 Live streaming has two modes: streaming on Clutch's own channel, where Clutch is the publisher; or, if you connect your own account, streaming on your or the venue's/organiser's channel, where that party is the publisher and is responsible for the stream and bound by the streaming platform's terms.

8.5 We use footage and images for marketing only with your consent (Section 7). Where a minor may be identifiable in footage, the responsibility to obtain parental or guardian consent for any public or marketing use rests with the venue or organiser, and we restrict such use accordingly.

9. How we share your data

We share personal data with:

  • (a) venues — for sessions recorded at their venue, which they access and control for their own purposes;
  • (b) tournament organisers — the registration and participation data for events you join, which they control for running the event;
  • (c) our payment partner, Razorpay, to process payments and settlements (card and similar details are handled by the payment partner, not stored by us);
  • (d) service providers who host and support the apps and website, under contracts that require them to protect your data and use it only on our instructions;
  • (e) the streaming platform, where you or a venue/organiser chooses to stream;
  • (f) courts, regulators, or authorities where required by law; and
  • (g) an acquirer or successor in a merger, restructuring, or sale of business, subject to this Policy.

Venues and organisers act as independent controllers for the data they receive and have their own obligations under data-protection law.

10. Cookies, analytics, and similar technologies

10.1 Our website and web app use cookies and similar technologies — including web beacons and tracking pixels — to keep you signed in, remember your preferences, measure usage, and understand what is popular. Most browsers accept cookies by default; you can remove or reject non-essential cookies through your browser or our cookie settings, though some features may not work properly if you do.

10.2 We use Microsoft Clarity and Microsoft Advertising to understand how visitors use our website through behavioural metrics, heatmaps, and session replay, captured using first- and third-party cookies and similar technologies, and used for improving and marketing our services, site optimisation, and security. 11. Connected accounts and third-party services

11.1 You can sign in with or connect third-party accounts — for example, a Google or social-media account, or a streaming account such as YouTube to stream on your own channel. When you connect an account, we receive limited information from it as needed to provide the feature, and your use of that third-party service is also governed by its own terms and privacy policy.

11.2 Our apps use maps and location features provided by Google (Google Maps). Your use of those features is subject to Google's terms, and Google's privacy policy explains how Google handles that data.

12. Where your data is processed

Your data is processed primarily in India. Any transfer of personal data outside India is made only as permitted under the Digital Personal Data Protection Act, 2023, and, where data is also subject to foreign data-protection law, under an appropriate transfer mechanism such as Standard Contractual Clauses.

13. How long we keep it

We keep your personal data for as long as your account is active and as needed for the purposes in this Policy, and afterwards only as required to meet legal, tax, accounting, or dispute-resolution obligations. In some cases we may keep certain information longer — for example, where you have an outstanding amount due to or from us, or where we are resolving a suspected fraud or a breach of our Terms of Service — and will address that before deleting. Recordings are retained according to the retention settings shown in the app. When data is no longer needed, we delete or anonymise it.

14. How we protect your data

We use appropriate technical and organisational measures to protect personal data, including access controls on a least-privilege basis, encryption in transit and at rest, monitoring, secure development practices, and a defined process for handling any data breach. No system is perfectly secure, but we work to keep your data safe and to notify you and the Data Protection Board of India of a breach where the law requires.

15. Your rights

Under the Digital Personal Data Protection Act, 2023 you have the right to:

  • access a summary of the personal data we process about you;
  • have it corrected, completed, updated, or erased;
  • nominate another person to exercise your rights if you are unable to; and
  • withdraw your consent.

You can exercise these rights in the app, or by writing to our Grievance Officer. We may need to verify your identity before acting on a request.

16. Grievance redressal

If you have a complaint about how we handle your personal data, contact our Grievance Officer, Sharath Kumar, at contact@theclutchsports.com. We will acknowledge and respond within the timelines required by law. If you are not satisfied with our response, you may escalate your complaint to the Data Protection Board of India. 17. Changes to this Policy

We may update this Policy from time to time. This Policy is published at https://www.theclutchsports.com/legal/privacy and is identified by its version date. If we make a material change, we will notify you in the app (for example, by a notice you must acknowledge) before it applies to you.
